PRIVATE AUCTION SALE REGULATIONS
ARMY IMPORT ITALIA BY MARCO VAULA

The sale is promoted by:
ARMY IMPORT ITALIA BY MARCO VAULA, with registered office at VIA BRUNO BUOZZI 9, 10024, MONCALIERI, ITALY, VAT No. IT12802620018, hereinafter the “Seller”.
- Subject of the sale
The sale concerns used movable property consisting of: MILITARY SURPLUS ITEMS SUCH AS CLOTHING, ACCESSORIES, AND EQUIPMENT.
The goods are divided into lots, described in the published catalog.
- Nature of the sale
The sale takes place through a voluntary private auction pursuant to Articles 1336 and 1470 of the Italian Civil Code.
The auction consists of a competition between bidders with the award going to the highest bidder.
- Participation procedures
Participation is open to:
- individuals of legal age
- legal entities
Required:
- full acceptance of these regulations
The Seller reserves the right to refuse admission.
- Security deposit
A security deposit is NOT required to participate.
- Inspection of goods
The goods are sold:
“as is, where is” in their current factual and legal state
Prior inspection is strongly recommended at:
ARMY IMPORT ITALIA BY MARCO VAULA – VIA BONISSANI 61, 12040, CERESOLE D’ALBA, ITALY.
By appointment.
- Description of lots
The descriptions in the catalog:
- are indicative and not exhaustive
- do not constitute an absolute guarantee
Any errors or omissions do not give rise to claims except in cases of willful misconduct or gross negligence.
- Auction procedures
The auction takes place: ONLINE
Features:
- minimum bid increments: €10
- closing time: ESTABLISHED FOR EACH SALE
- automatic 3-minute extension in case of bids in the last 3 minutes
The Seller reserves the right to:
- suspend or cancel the auction
- withdraw lots
- Reserve price
The Seller may set a minimum price (reserve).
If not reached:
- the lot may not be awarded
- Awarding
The award is:
- provisional until confirmed by the Seller
- final upon confirmation
The successful bidder is obligated to purchase.
- Payment
Payment must be made within: 5 WORKING DAYS
Methods:
- bank transfer
- other traceable payment methods
In case of non-payment:
- suspension of bidding rights
- cancellation of the award
- Invoicing and VAT
Sales are subject to:
- issuance of an invoice
- application of VAT according to current regulations (+ 22%)
ATTENTION: all prices shown are to be understood as VAT excluded. Taxes will be added at checkout.
- Collection of goods
Collection must take place within: 10 DAYS FROM THE SELLER’S NOTICE
At the buyer’s expense:
- transport
- collection
After this period:
- storage costs of €10 per day may be applied
- Warranty – Consumers
If the buyer is a consumer pursuant to Legislative Decree. 206/2005:
- duration: 12 months (used goods)
Excluded:
- obvious defects
- normal wear and tear
- Warranty Exclusion – Professional Operators
For sales between professionals:
- the warranty is limited to hidden defects only
- within the limits of the law
- Right of withdrawal
There is no right of withdrawal, as this is an auction sale.
- Liability
The Seller is not liable for:
- indirect damages
- loss of use of the goods
- non-substantial errors in descriptions
- Unfair clauses
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the buyer specifically approves:
- “as is” clause
- exclusions of liability
- payment terms
- forfeiture of security deposit
- Privacy
Personal data will be processed pursuant to EU Regulation 2016/679 (GDPR).
- Applicable law and jurisdiction
The sale is governed by Italian law.
Jurisdiction: TURIN
- Acceptance
Participation in the auction implies:
“full acceptance of these regulations”
